Dutch Player Won't Get Money Back from Unibet

A Dutch court has made an important decision on March 27, concluding that a player's gambling losses could not be refunded by the online operator where he played, even as the latter was unlicensed in Holland, where the betting originated. A Dutch gambler lost some €170k at Unibet's online proprieties from June 2010 to January 2012 and he decided he would try to recoup his losses, taking advantage of fact that
Unibet did not possess a Dutch license on the games he had played.
The court made it clear that Unibet's Dutch operation was in fact illegal and contrary to the Dutch Betting and Gaming Act. Despite that, according to the ruling, the operator would not be compelled to repay the above said sum. The actual identity of the gambler involved in the case has not been revealed.

The case was apparently a special one: according to Dutch law, online gambling/poker operators need to have measures in place to prevent and to stop problem-gambling, and the authorities had apparently conducted a lengthy investigation focused on this very aspect, concluding that Unibet couldn't be held responsible for any sort of wrongdoing.
The decision was obviously a massive victory for Unibet, who not only got to keep the money, but saw the efficiency of their anti-problem gambling policies and the legitimacy of their operation recognized and validated by the court as well. The fiasco also made the necessity of a clear and concise legal network governing these online activities in the Netherlands quite obvious. There is actually a bill concerning the regulation of online gambling in the country, but it is only scheduled to be discussed and considered later this year.
